To the fullest extent permitted by applicable law, you hereby release, discharge, and hold harmless Vitaltide LLC, its owners, members, officers, employees, agents, contractors, affiliates, suppliers, and successors (collectively, "Released Parties") from any and all claims, demands, causes of action, damages, losses, costs, and expenses (including attorneys' fees) arising out of or related to: (a) your purchase, receipt, or possession of any Product; (b) your use or misuse of any Product; (c) any injury, illness, death, or property damage resulting from any Product; (d) your violation of any applicable law or regulation; or (e) any breach of the representations and warranties set forth herein. 3.3 INDEMNIFICATION. You agree to indemnify, defend, and hold harmless the Released Parties from and against any third-party claims, regulatory actions, investigations, fines, penalties, damages, and legal fees arising from your breach of these Terms or your use of the Products. 3.4 LIMITATION OF LIABILITY. IN NO EVENT SHALL VITALTIDE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR DEATH, EVEN IF VITALTIDE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. VITALTIDE'S TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. ───────────────────────────────────────────── ARTICLE IV: PURITY, QUALITY, AND NO GUARANTEE OF RESULTS ───────────────────────────────────────────── 4.1 Vitaltide produces all compounds to ≥99% chromatographic purity as verified by independent third-party reverse-phase HPLC analysis and confirmed by mass spectrometry. Certificates of Analysis (COA) are available upon request. 4.2 Purity specifications refer strictly to the chemical identity and composition of the compound as measured under laboratory analytical conditions.
